These Terms and Conditions govern purchases made through varmers.com. By placing an order, the customer agrees to these terms.

1. Seller

The seller is Varmers Growing Tech Co., Ltd., trading as Varmers.

2. Products

We sell fresh herbs, leafy greens, sprouts, microgreens and related products. Product photographs and descriptions are provided to help customers make purchasing decisions.

Fresh agricultural products naturally vary in colour, size, shape, weight and appearance. Images are illustrative, but the product supplied must materially correspond with its description.

3. Product availability

All orders are subject to availability. Displaying a product as available does not create a binding obligation until we accept the order.

If an ordered product becomes unavailable, we may contact the customer regarding a substitute, remove the item and refund it, or cancel and refund the affected order.

4. Prices and charges

Prices are displayed in Thai baht and are the prices applicable when the order is placed, subject to correction of obvious errors.

Delivery charges and any other mandatory charges are shown before the customer confirms payment. We will not impose undisclosed mandatory charges after checkout.

5. Orders and contract formation

Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean that the order has been accepted.

A contract is formed when we expressly accept the order, begin preparing it, or dispatch it, whichever occurs first. We may refuse or cancel an order for legitimate reasons, including unavailability, payment failure, suspected fraud, pricing error or inability to deliver.

6. Payment

The payment methods currently offered are shown at checkout. The customer confirms that they are authorised to use the selected payment method.

Orders may be placed on hold or cancelled if payment cannot be authorised or if additional verification is reasonably required.

7. Delivery

Delivery locations, estimated times and charges are described at checkout and in our Shipping and Delivery Policy, which forms part of these terms.

Customers must provide accurate contact and delivery information and ensure reasonable access for delivery.

8. Inspection and storage

Customers should inspect the order promptly after delivery and store fresh products according to appropriate food-safety and refrigeration practices.

Problems should be reported within the time stated in our Returns and Refunds Policy.

9. Returns, refunds and cancellations

Our Returns and Refunds Policy forms part of these terms. Correctly supplied perishable products generally cannot be returned for a change of mind, but this does not limit statutory rights.

10. Promotions and discount codes

Promotions and discount codes may be subject to separate conditions, validity periods, eligibility rules and stock availability. Unless stated otherwise, promotions cannot be combined and have no cash value.

11. Website use and intellectual property

The website, branding, text, photographs, graphics and other content are owned by or licensed to Varmers and are protected by applicable intellectual-property laws.

Customers may use the website for lawful personal or business purchasing purposes. Automated scraping, interference with site operation, fraudulent activity and unauthorised commercial reuse are prohibited.

12. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

To the extent permitted by law, we are not responsible for indirect or consequential loss, loss caused by misuse or improper storage, or delay caused by events outside our reasonable control.

13. Force majeure

We are not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, flooding, transport disruption, public emergencies, labour disruption, crop failure, utility interruption and system outages. We will take reasonable steps to minimise the impact.

14. Privacy

Personal information is handled in accordance with our Privacy Policy, Data Protection Policy and Cookie Policy.

15. Governing law

These terms are governed by the laws of Thailand. Nothing in this clause prevents a consumer from relying on any mandatory protections that apply to them.

16. Changes and contact

We may update these terms from time to time. The version published when an order is placed applies to that order unless a change is required by law.
